Official Contest Rules, Terms & Conditions

Important Notice

This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc. By entering, participants fully release Instagram and Meta from any and all liability related to this contest. This document constitutes the complete and binding Official Rules of the promotion.

1. About This Promotion

Minarium ("Sponsor", "we", "us") is operating the Giveaway (the "Promotion") on Instagram to celebrate the growth of the Minarium platform and to grow our community of 3D printing tabletop miniature enthusiasts. No purchase is necessary to enter or win.

2. Promotion Period & Schedule

Each giveaway drop runs for exactly seven (7) calendar days as set out below. The Sponsor reserves the right to extend or shorten any individual drop period due to technical issues, force majeure, or other circumstances at its sole discretion. All times are Pacific Time (PT).

Actual dates will be substituted for placeholders above prior to the launch of each drop. The specific dates will be published on the Minarium Instagram profile (@minarium) and on the Minarium website at minarium.com/giveaway.

3. Eligibility

To be eligible to enter and win, each participant must:

1. Be a legal resident of the fifty (50) United States or the District of Columbia.
2. Be at least eighteen (18) years of age at the time of entry.
3. Have a valid, public Instagram account in good standing at the time of entry and at the time of winner verification.
4. Follow the @minarium Instagram account as of the entry deadline for the relevant Drop.
5. Not be an employee, officer, director, contractor, agent, or immediate family member (spouse, parent, sibling, or child) of Minarium or any of its affiliated entities, partner creators contributing prizes, or their respective affiliates.
6. Not be acting on behalf of, or under any agreement with, a competitor of Minarium.

Void where prohibited

This Promotion is void where prohibited or restricted by law. Participants are solely responsible for compliance with all applicable local, state, and federal laws in their jurisdiction of residence.

4. How to Enter - Entry Mechanics

There is no purchase necessary. To obtain one (1) entry per Drop, a participant must complete all of the following steps during the applicable Drop Period:

1. Follow the @minarium Instagram account (if not already following).
2. Like the official giveaway post published by @minarium for the relevant Drop.

Bonus Entries

In the comments section of that same giveaway post, tag at least one (1) other Instagram user. Each comment containing at least one valid tag counts as one (1) additional entry. There is no limit on the number of entries per person per Drop; however, each comment must contain a genuine tag of a real, separate Instagram user. Tagging the same account multiple times, self-tagging, or tagging inactive or fake accounts will result in disqualification of those entries.

Participants may earn one (1) additional entry per Drop by sharing the official giveaway post to their Instagram Story and tagging @minarium in that Story. Bonus entries will be verified manually by Minarium staff within twenty-four (24) hours of Story publication. Because Instagram Stories expire after twenty-four (24) hours, participants must share their Story at least twenty-four (24) hours before the Drop close time to qualify for the bonus entry.

Alternative Method of Entry (AMOE)

No purchase is necessary. As an alternative method of entry that requires no Instagram account, participants may submit one (1) entry per Drop via email to contact@minarium.com with the subject line "[Drop Number] Giveaway Entry" and their full name and state of residence in the body of the email. AMOE entries receive one (1) entry equivalent and are not eligible for the bonus Story entry.

5. Prize Description & Delivery

Prize per Drop

One (1) winner per Drop will receive a single digital STL file (the "Prize File") donated by a participating creator partner. The specific file to be awarded for each Drop will be identified in the corresponding giveaway post. The approximate retail value ("ARV") of each Prize File is between $5.00 and $25.00 USD, depending on the creator and file.

Digital Delivery

Prize Files will be delivered via Instagram Direct Message (DM) or email to verified winners within five (5) business days of winner verification and confirmation. Minarium is not responsible for failed delivery due to incorrect contact information provided by the winner, a full DM inbox, or spam filters.

No Cash Equivalent

Prizes are non-transferable and no cash equivalent, substitution, or alternative prize will be offered, except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute a prize of equal or greater value in the event that the specified prize becomes unavailable.

No Other Compensation

Winning a Prize does not entitle the winner to any subscription, membership, platform credit, merchandise, or other benefit from Minarium beyond the specified digital file.

6. Digital File License & Intellectual Property

Each Prize File is the original intellectual property of the creator partner who donated it ("Creator"). By accepting the Prize File, the winner agrees to the following conditions:

1. Personal use only. The Prize File is licensed to the winner for personal, non-commercial use exclusively. The winner may print the model for personal enjoyment, display, or as a gift to an individual.
2. No redistribution. The winner may not share, upload, re-host, sell, rent, transfer, sublicense, or otherwise distribute the Prize File in digital form, on any platform, including but not limited to MyMiniFactory, Cults3D, Thingiverse, Patreon, Discord, or any file-sharing service.
3. No commercial use. The winner may not sell or offer for sale physical prints produced from the Prize File, whether individually, in bulk, or as part of any commercial activity.
4. No derivative works. The winner may not modify, remix, or create derivative works based on the Prize File without the express written permission of the Creator.
5. Copyright ownership. All copyright and intellectual property rights in the Prize File remain with the Creator at all times. Receipt of the Prize File does not constitute a transfer of ownership or any rights beyond the personal-use license described herein.

7. Winner Selection & Notification

Selection Method

One (1) winner per Drop will be selected by random draw from all eligible entries for that Drop using Comment Picker or equivalent verified random selection software. The draw will take place within forty-eight (48) hours of the close of each Drop Period. Selection is subject to verification of eligibility.

Notification

The potential winner will be notified via Instagram Direct Message from @minarium within forty-eight (48) hours of selection. Minarium will also announce the winner publicly via Instagram Story and/or a post comment on the original giveaway post.

Response Deadline

The potential winner must respond to the winner notification DM within seventy-two (72) hours of its delivery to claim their prize. Failure to respond within this window will result in forfeiture of the prize and selection of an alternate winner from the remaining eligible entries. Minarium may repeat this process up to three (3) times before the prize is forfeited entirely for that Drop.

Verification

Before the prize is delivered, the potential winner must confirm that they: (a) followed @minarium at the time of entry; (b) liked the applicable giveaway post; (c) submitted a valid entry comment; and (d) meet all eligibility requirements. Minarium reserves the right to disqualify any winner who cannot confirm these requirements.

8. General Contest Rules

1. Limit one (1) entry per like (excluding bonus Story entry and comment entry). Duplicate comment entries from the same account for the same Drop will be disqualified.
2. Entries must be submitted during the applicable Drop Period. Late entries will not be accepted.
3. Automated entries, bots, scripts, or any other method that does not constitute genuine human participation are strictly prohibited and will be disqualified.
4. Minarium reserves the right, in its sole discretion, to disqualify any participant who tampers with the entry process, acts in a disruptive or unsportsmanlike manner, or violates any of these Official Rules.
5. Minarium is not responsible for lost, late, misdirected, incomplete, or illegible entries, or for any failure of electronic transmission.
6. Must have a Minarium account to receive the digital files. An account can be created at <www.minarium.com>.
7. By entering, participants grant Minarium permission to feature their Instagram username in winner announcements and to repost any UGC (user-generated content, including prints of the Prize File) they share and tag @minarium, with appropriate credit.
8. Minarium reserves the right to cancel, suspend, or modify the Promotion at any time for any reason, including if fraud, technical failure, or other factors impair the integrity of the Promotion, as determined by Minarium in its sole discretion.

9. Taxes & Reporting

Winners are solely responsible for all federal, state, and local taxes applicable to any prize received.

10. Publicity & Consent

Except where prohibited by law, by accepting a prize, each winner consents to Minarium's use of their Instagram username, likeness, and general geographic location (state only) for promotional and advertising purposes in any media, worldwide, without additional compensation or prior notice.

11. Release & Limitation of Liability

By participating, each entrant agrees to release, discharge, and hold harmless Minarium, its affiliates, officers, directors, employees, agents, partner creators, and successors from any and all liability for any injury, loss, or damage of any kind arising from or in connection with: (a) participation in this Promotion; (b) acceptance, use, or misuse of any prize; (c) any malfunction or failure of electronic equipment, software, or internet connectivity; or (d) any typographical or other errors in these Official Rules or any promotional materials.

THE PRIZE FILES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. MINARIUM MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE SUITABILITY OF ANY PRIZE FILE FOR ANY SPECIFIC PRINTER, RESIN, FILAMENT, SLICER, OR PRINT SETTING. WINNERS PRINT AT THEIR OWN RISK.

12. Disputes & Governing Law

These Official Rules and all issues relating to this Promotion are governed by the laws of the State of IOWA, United States, without regard to its conflict-of-laws provisions. Any dispute arising out of or relating to this Promotion shall be resolved exclusively through binding arbitration in Des Moines, IOWA under the rules of the American Arbitration Association. Each participant waives any right to participate in a class action lawsuit or class-wide arbitration.

13. Privacy & Data

Minarium will collect and use personal information (including Instagram usernames and, if submitted via AMOE, email addresses and names) solely for the purpose of administering this Promotion, verifying eligibility, selecting and notifying winners, and delivering prizes. Minarium will not sell or share this information with third parties except as required by law or as necessary to deliver prizes. By entering, participants consent to this data use. 14. Instagram Disclaimer

This Promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc. All questions, comments, and complaints regarding the Promotion must be directed to Minarium and not to Instagram or Meta. By entering this Promotion, each participant releases Instagram and Meta from all liability in connection with the Promotion.
